Terms of Service
These are the terms between you and cloakup — a private AI chat where your personal details are cloaked on your own device before your message is ever sent. cloakup is a consumer product operated by Klokk Nettablering and runs on CloakAPI's privacy-preserving infrastructure.
1. What cloakup is
cloakup lets you chat with AI models about real things — your clients, your patients, your books — without handing your personal details to the AI. Before your message leaves your device, cloakup detects personal data (names, emails, phone numbers, card and ID numbers, and similar) and replaces it with realistic stand-in tokens. Only the tokenised version is sent onward through the CloakAPI gateway to the AI model. The reply is un-cloaked back to the real details in your browser, using a token map that never leaves your device.
The AI models are run by third-party providers, reached through CloakAPI's gateway. cloakup is not the model author and does not control what a model generates.
2. Accepting these terms
By using cloakup you agree to these Terms and to our Privacy Policy. If you start a paid subscription, you confirm your agreement again at checkout. If you do not agree, please do not use cloakup.
You must be old enough to enter a binding contract in your country (at least 16, or the age of digital consent where you live). cloakup is intended for personal and small-business use.
3. Your account
Some features (subscriptions, saved chat history across devices) need an account. You are responsible for keeping your sign-in secure and for activity under your account. Free trial usage is metered per device; a subscription is tied to your account.
4. Subscriptions, billing & cancellation
- Plans. cloakup offers Personal ($12 / month) and Business ($29 / month per person). Prices are shown on the cloakup home page and may change with notice; the price in effect when you subscribe applies to your current billing period.
- Payments. Billing is handled by Stripe. We do not see or store your full card number — Stripe is the payment processor. Your card statement will show CloakAPI as the descriptor.
- Auto-renewal. Subscriptions renew automatically each month until you cancel. You can cancel any time from Manage subscription inside cloakup (which opens the Stripe customer portal). Cancellation stops the next renewal; you keep access until the end of the period you already paid for.
- Refunds. Monthly fees are generally non-refundable once a period has started, except where a refund is required by your consumer-protection law (for example the EU/EEA 14-day right of withdrawal, which may be limited once a digital service has been used with your consent). If something went wrong on our side, contact hello@cloakapi.io and we'll make it right.
- Tax. Prices are shown excluding VAT unless stated otherwise. Norwegian VAT is added where it applies; for EU business customers with a valid VAT ID, the reverse-charge rule may apply.
5. Acceptable use
You agree not to use cloakup to:
- break the law, infringe someone else's rights, or send malicious code;
- try to defeat the on-device cloaking, extract another user's data, or attack the service or the CloakAPI gateway;
- generate content that sexually exploits minors, or that is used to harass, defraud or harm others;
- resell or redistribute cloakup as your own service.
You remain responsible for what you choose to send and for how you use the AI's answers.
6. Who owns what
You own your prompts and the AI's outputs to the extent the law allows — cloakup claims no ownership of your content and does not use it to train any model. We own the cloakup software, design, and the CloakAPI technology behind it.
7. Honest limits & disclaimers
cloakup gives a real but bounded privacy guarantee. Being clear about its limits is part of the product:
- Detection is best-effort. Structured identifiers (emails, phone numbers, cards, IBANs, ID numbers) are caught very reliably. Names are best-effort — an on-device name list catches common names, and the optional paid on-device AI name model improves coverage, but an unusual name or a name in a non-Latin script can still slip through. Review anything highly sensitive before you send it.
- The AI's answer is the model's. Cloaking protects what you send. It cannot control what a model writes back, and AI output can be wrong, biased, or made up. Do not rely on it as professional (legal, medical, financial) advice.
- The service is provided "as is." We work hard to keep cloakup available and correct, but we do not warrant it will be uninterrupted or error-free.
8. Liability
To the extent the law allows, cloakup's total liability to you for any claim is limited to the fees you paid us in the 12 months before the claim. We are not liable for indirect, incidental, or consequential loss, or lost profits. Nothing here limits liability that cannot be limited by law (including for gross negligence or wilful misconduct), or your mandatory consumer rights.
9. Ending your use, and deleting your data
You can stop using cloakup and delete your account at any time. You can delete any individual conversation from the interface whenever you like. When you close your account we delete your account data and stored conversations, keeping only what tax and bookkeeping law requires — invoices and financial records for the Norwegian Bokføringsloven statutory minimum of 5 years, in a minimised form. We may suspend or end access if these Terms are seriously breached.
10. Changes
We may update these Terms. For material changes we'll give reasonable notice (in-product or by email to subscribers) before they take effect. Continuing to use cloakup after a change means you accept the updated Terms.
11. Governing law
These Terms are governed by Norwegian law, without displacing any mandatory consumer-protection rights you have where you live. Disputes fall to the courts of Norway (Oslo tingrett), subject to those consumer rights.
